Terms of Use

1. Agreement

These Terms of Use are an agreement between you and Songtive SIA (“Songtive”, “we”, “us”), a company registered in Latvia, for the Icky mobile app and the website ickyapp.com (together, “Icky”). By downloading, opening or using Icky you accept these terms and our Privacy Policy. If you do not accept them, do not use Icky.

2. What Icky is

Icky is a self-help app for getting over a breakup. It includes a no-contact streak counter, a Panic Button for the urge to contact your ex, daily mood check-ins with a journal, grounding and breathing exercises, unsent messages, an AI companion by text or voice, reminders and, on iPhone, home-screen widgets. Features can change over time.

3. What Icky is not

Icky is not therapy, medical care, a diagnosis or a crisis service, and nothing in it is professional advice. It does not replace a doctor, a psychologist or a therapist. If you are in danger or thinking about hurting yourself, call your local emergency number now. In the US you can call or text 988.

4. Who can use Icky

You must be at least 13 years old. If you are under 18, you may use Icky only with the permission of a parent or guardian, who accepts these terms for you.

5. Your account

You sign in with Apple, with Google, or with an email address and a password. Keep your sign-in details safe; you are responsible for what happens in your account. You can delete your account at any time in the app under Profile > Delete account.

6. The AI companion

  • The companion is an AI model, not a person. Its answers are generated automatically, can be wrong, incomplete or unsuitable for your situation, and are not professional advice.
  • Do not use it for emergencies, and do not make medical, legal, financial or safety decisions based only on what it says.
  • To answer you, your messages and a short summary of your situation are processed by our AI provider, as described in the Privacy Policy.
  • Use of the companion is subject to fair-use limits per day and per month. When you reach a limit, the companion pauses until the limit resets.

7. Icky Pro, subscriptions and trials

  • Icky is free to download. Full access requires Icky Pro, an auto-renewing subscription. The plans, prices, billing periods and any free trial are shown in the app and in the App Store or Google Play before you buy, and can differ by country.
  • Payment is charged to your Apple ID or Google Play account when you confirm the purchase, or when the free trial ends if you started one.
  • The subscription renews automatically at the end of each period at the then-current price, unless you cancel it at least 24 hours before the period ends. Cancel in your App Store or Google Play account settings. Deleting the app or your Icky account does not cancel it.
  • If you cancel during a free trial, you are not charged. Any unused part of a free trial ends when you buy a subscription.
  • Refunds are handled by Apple or Google under their refund policies. We cannot issue refunds for store purchases ourselves.
  • If we change a price, the store tells you before the new price applies, as its rules require.

8. Your content

What you write in Icky (journal entries, unsent messages, exercise answers, conversations) stays yours. You give us a limited, non-exclusive licence to store and process it only to run Icky for you: to save it, sync it and let the AI companion respond. We do not publish your content, and we do not use it for advertising. Unsent messages are never sent to anyone.

9. Acceptable use

You agree not to:

  • use Icky for anything unlawful, or to harass, threaten or harm another person;
  • try to access other users' data, our servers or our providers without permission;
  • interfere with Icky, get around its limits, or use bots or scripts against it;
  • use the AI companion to create harmful, illegal or abusive content, or to get around its safety rules;
  • copy, resell, reverse-engineer or build a competing service from Icky, except where the law allows it.

We may suspend or close an account that breaks these rules.

10. Intellectual property

Icky, its design, code, text, illustrations, the Icky character and the Icky name belong to Songtive or its licensors and are protected by law. We give you a personal, non-transferable, revocable licence to use the app on devices you own or control, under these terms and the rules of the store you got it from.

11. Availability and changes

We work to keep Icky available, but we do not promise it will always be uninterrupted or error-free. We can update, change or remove features, and we can stop offering Icky. If we stop Icky completely, we will tell you in advance where we can.

12. Disclaimer

Icky is provided “as is” and “as available”. To the extent the law allows, we give no warranties, express or implied, including that Icky will meet your needs or help you reach a particular result. Your consumer rights under the law of your country are not affected.

13. Limitation of liability

To the extent the law allows, Songtive is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill, arising from your use of Icky. Our total liability for any claim is limited to the amount you paid for Icky in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

14. Ending these terms

You can stop using Icky and delete your account at any time. We can end these terms or suspend your access if you break them. Sections 8 (licence ends when your content is deleted), 10, 12, 13 and 16 continue after the end.

15. Apple App Store

If you got Icky from the App Store: these terms are between you and Songtive, not Apple. Apple is not responsible for Icky, its content, maintenance or support, or for any claims about it. If Icky fails to meet a warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Apple's Standard End User License Agreement also applies where these terms do not cover a matter.

16. Governing law

These terms are governed by the laws of the Republic of Latvia. Disputes go to the courts of Latvia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring a claim there.

17. Changes to these terms

We may update these terms. We post the new version on this page with a new effective date and, for a significant change, tell you in the app. If you keep using Icky after a change takes effect, you accept the new terms.
